How to correctly terminate a rental

Lease termination is governed by § 2285-2296 of the Civil Code. Key rules: notice must be in writing (§ 2286) and provably delivered - we recommend registered mail with return receipt or personal handover with signature.

The notice period runs from the first day of the month following delivery. If notice is delivered on March 15, the period starts April 1 and with a 3-month notice period the lease ends June 30.

The tenant in an open-ended contract may give notice without reason (§ 2231). For a fixed-term contract only on grounds of § 2287 (material change of circumstances).

The landlord may give notice only for statutory reasons (§ 2288) - typically non-payment for 3 months, breach, or need of the property. For a particularly serious breach (§ 2291) notice may be given without notice period.
